Terms of Service v2026-09-08.1

Last updated: September 8th, 2026

These Terms of Service ("Terms") govern your use of the website and checkout of The Last Logoff, LLC, a Wisconsin company ("we," "us"). By using the site or purchasing a service, you agree to these Terms, our Privacy Notice, and — once you engage us — our Engagement Letter.

1. What our service is (and is not)

We help families and account holders close, memorialize, or inventory digital accounts. We submit requests through the official process each platform provides. The platforms decide outcomes and timelines.

We do not guarantee any particular outcome or timeline. Whether and when a platform closes, memorializes, transfers, or releases an account is the platform's decision, not ours. We perform our work diligently; we do not control the result.

We do not provide legal, financial, or tax advice. Helping complete a platform form is clerical (scrivener) work using the facts you supply; reviewing your documents is a legibility and name/date check, not a legal opinion that any document is valid or sufficient. For legal questions — probate, executor authority, inheritance, digital-asset law — consult a licensed attorney.

Out of scope: financial, investment, government, payment-app, and crypto-exchange accounts. We detect these and provide a checklist; next of kin handle them.

2. Eligibility and authorization

You must be at least 18 and able to form a binding contract. To engage us regarding another person's accounts, you represent that you are authorized to do so — as the account holder, or with the account holder's knowledge and agreement (pre-planning) or, post-death, as executor, administrator, surviving spouse, or next of kin with appropriate documentation. We may request proof of authority and may decline or pause service until it is provided. Full authorization terms are in the Engagement Letter and the Authorization to Act schedule.

3. Purchases, payment, and refunds

  • Payment is taken at checkout through Stripe. Prices are shown before purchase.
  • Refund policy (in full, below):
    • After a death. A full refund is available only if we cannot perform the service — for example, required documentation is not provided or does not pass verification within 30 days of payment. Once platform submissions begin, the work is not reversible and fees are not refundable. Disputing or charging back a payment after submissions begin does not reverse completed work, and the fee remains due.
    • Planning ahead. We do not ask for documents when you buy a plan, so nothing is due from you at purchase. Before your plan is activated, you can ask us to delete it at any time and we will refund your fee in full, to the card you paid with. If that card is closed by then, we will work out another way to get it back to you. When your plan is activated it becomes a case, and the case terms apply from that point. If we cannot perform the service — for example, the required documentation is not provided or does not pass verification within 30 days of activation — the fee is refunded in full. Once platform submissions begin, the work is not reversible and fees are not refundable.
  • The full refund and payment-dispute terms are in the Engagement Letter, which governs if there is any conflict with this summary.

4. Accounts

If you create an account on our site, you are responsible for keeping your login secure and for activity under it. These are credentials for our service only — we never ask for, and you should never enter, the passwords or recovery codes for the Subject's accounts.

5. Acceptable use

You agree not to: use the service for any unlawful purpose; misrepresent your identity or authority; upload documents you are not authorized to provide; attempt to breach, probe, or disrupt the site's security; or use the site to infringe anyone's rights. We may suspend or terminate access for violations.

6. Intellectual property

The site, its content, and our materials, checklists, and templates are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-transferable right to use the site to obtain our services. You retain ownership of the content and documents you provide to us.

7. Disclaimers

The site and service are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. As stated in Section 1, we make no guarantee of any platform outcome or timeline.

8. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or related to the site or service is capped at the amount you paid for the service, consistent with the Engagement Letter. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost opportunity, or emotional distress. Nothing here limits liability that cannot be limited under applicable law, including our own fraud or intentional misrepresentation.

9. Governing law

These Terms are governed by the law of the State of Wisconsin, without regard to conflict-of-laws rules. Savings clause: if you reside outside Wisconsin, the mandatory, non-waivable consumer-protection rights of your home state are not waived where they cannot lawfully be waived.

10. Changes

We may update these Terms. The "Last updated" date shows the most recent change. Continued use after a change means you accept the updated Terms.

Privacy Notice v2026-10-20.1

Last updated: October 20th, 2026

The Last Logoff, LLC ("we," "us") is a Wisconsin company that helps families and account holders close, memorialize, or inventory digital accounts. We serve clients nationwide. This notice explains what personal information we collect, why, how we store and protect it, how long we keep it, and who we share it with. We collect only what we need to do the work.

1. Information we collect

You give us directly:

  • Account and contact data — name, email address, and (if you create an account) login credentials for our site. These are credentials for our service, not for any of the Subject's accounts.
  • Case data — the name of the Subject, the accounts to be handled, your role (account holder, executor, administrator, surviving spouse, next of kin), and your instructions.
  • Proof-of-authority and death-certificate documents you upload. A death certificate and related proof-of-authority documents may contain sensitive personal information, including a Social Security number and cause of death. We treat this category as sensitive and handle it under the heightened controls in Sections 5 and 6.

We never collect: the passwords, security answers, recovery codes, 2FA secrets, or seed phrases for the Subject's accounts. We do not request, store, or hold those, ever.

Collected automatically:

  • Payment data via Stripe. When you pay, our payment processor (Stripe) collects and processes your card and billing information. We do not receive or store your full card number — Stripe handles card data directly.
  • Referral tracking. If you reach us through a referral partner link, we record the referral click and whether it converted to a paid case, so we can attribute the referral. With that record we store a one-way hash of your IP address, kept only so we can investigate suspected fraud. We do not store the raw address, and the hash is never used in our reporting or analytics.
  • Basic site/usage data as needed to operate and secure the site.
  • How you found us — the page you arrived on, the site that sent you (a search engine, for example), and, if you came from an advertisement, the click identifier the advertising platform added to the link. We use this only to learn which channels bring families to us. It is kept with your purchase record and is not sent back to any advertising platform.

If you buy a plan

A plan is different from a case, and this section says how.

When you buy a plan, the person whose accounts it covers — we call them the account holder — is still living. That may be you, or it may be someone else, such as a parent or a spouse.

What a plan holds. The account holder's name and email address. The accounts you list, which means the service, the account name or address you use there, and a link to the profile if you add one. Any note you attach to an account. The name and email address of the person you name to tell us when the time comes.

A note is free text, so it may contain whatever you write. Please do not put anyone else's personal information in it.

We contact the person you name. You will see the message before it goes, word for word, and nothing is sent until you choose to send it. If you never send it, we never contact them, and they hear from us for the first time when the plan is activated.

We do not ask for a death certificate when you buy a plan. We ask for it at the point the plan is activated, along with proof that the person activating it has the authority to act.

How long we keep a plan. A plan does not expire. We keep it until it is activated, or until you ask us to delete it. That is the point of it — a plan bought years before it is needed has to still be there.

Changing or deleting a plan. You can add or remove accounts yourself at any time, up until the plan is activated. To delete a plan entirely, email us at contact@thelastlogoff.com and we will delete it and confirm that we have.

Once a plan is activated it becomes a case, and the rest of this notice applies to it: the death certificate and proof-of-authority documents are deleted ninety days after the case closes, and the case record is kept for the period in Section 6.

The person you name. We hold that person's name and email address so we can reach them when the plan is activated. We do not create an account for them, and we do not contact them for any other reason. If you have not sent them the message, they will not know the plan exists until it is activated. You can change who you have named at any time.

2. Website analytics

Nothing about your case — names, documents, accounts, or payment details — is ever shared with an analytics provider.

3. Why we use your information

  • To provide the service — identify accounts and submit platform requests.
  • To verify the authority of the person instructing us.
  • To take payment and issue refunds.
  • To attribute referrals to partners.
  • To secure the site, prevent fraud, and meet legal, tax, and record-keeping obligations.

We do not sell your personal information, and we do not use death-certificate or case data for advertising.

4. Who we share it with

  • Platforms and account providers — we share only what a given platform requires to process a deceased-user, legacy, or account request, and, where you have written one, a short note about a specific account. We share the minimum necessary for each platform.
  • Stripe — our payment processor, which processes your payment under its own privacy policy.
  • Referral partners — limited confirmation of whether a referred contact became a case, for attribution. We do not share case contents or death-certificate data with referral partners.
  • Service providers that host or secure our systems, under confidentiality obligations.
  • Legal and safety — where required by law or to protect rights and safety.

Notes you write about an account

When you name an account, you can attach a short note about it. We read every note. If it fits what we are able to ask a platform for, we may pass it on with the closure request. Notes are not sent unless we decide to send them.

If a note names another person or includes their contact details, that information goes to the platform with it. Please do not put anyone else's personal information, passwords, or security codes in a note.

5. How we store and secure it

  • Sensitive documents (death certificates, proof of authority) are held in a secure, access-controlled store with encryption at rest, restricted access, and access logging.
  • We share with each platform only what it requires. Where a platform does not require it, we mask the Social Security number and the cause of death on the copy of the death certificate we send. Some platforms require an unaltered certified copy; where that is so, we send it as issued.
  • Accounts on our site are protected by authentication, with multi-factor authentication offered.

6. How long we keep it (retention) and the 90-day evidence deletion

If you bought a plan and it has not been activated, see "If you buy a plan" above — a plan is kept until it is activated or you ask us to delete it.

  • Evidence documents — death certificates and proof-of-authority documents — are deleted ninety (90) days after the case closes, and the deletion is logged.
  • Case records and the audit log (metadata about what was requested, submitted, and completed, without the sensitive evidence images) are retained for seven (7) years so we can defend against claims and meet tax obligations. These two periods are different on purpose: the documents you upload are deleted at ninety days, while the record of what was done on your case is kept for seven years.

7. "Do Not Track" disclosure (CalOPPA)

Some browsers send a "Do Not Track" signal. There is no industry-standard response to that signal. We do not track our visitors across third-party websites over time, and we do not serve targeted advertising, so we do not change our behavior in response to a Do Not Track signal.

8. Your choices and rights

You may request access to, correction of, or deletion of your personal information by contacting us at contact@thelastlogoff.com. We will respond as required by applicable law. Depending on your home state, you may have additional rights under your state's privacy law; we will honor non-waivable rights your state provides.

9. Children's data

Our service is intended for adults handling the digital accounts of adults. It is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it.

10. Data breach and how to reach us

If we become aware of unauthorized acquisition of personal information, we will notify affected individuals as required by law. Wisconsin's breach-notification law (Wis. Stat. § 134.98) requires notice within a reasonable time, not to exceed 45 days, of discovery; because we serve clients nationwide, we will also meet the breach-notification requirements of an affected individual's home state.

To reach us about privacy or a suspected breach:

11. Changes to this notice

We may update this notice. The "Last updated" date above shows the most recent change.

Engagement Terms v2026-09-04.1

Last updated: September 4th, 2026

Between: The Last Logoff, LLC, a Wisconsin limited liability company ("we," "us," "the Company") and the individual who engages us ("you," "the Client"). The Client, the Subject whose accounts are handled, the service mode, and the date are recorded on the engagement you accept at checkout.

1. Parties and scope of service

The Company provides one of the following services:

  • Post-death closure or memorialization. We identify the Subject's digital accounts and submit requests to close, memorialize, or inventory those accounts, acting only through the official process each platform provides for deceased or incapacitated account holders. We act on your instructions as the authorized Client.
  • Pre-planning. The Subject records the digital accounts to be closed, and may leave instructions for any of them. We hold that record until the plan is activated, and then close the listed accounts. In pre-planning, the Subject is the account holder and signs for themselves.

In every mode: platforms decide outcomes and timelines. We submit and follow requests diligently; we do not control whether or when a platform acts. This is the core fact that limits what we can promise (see Section 6).

What this engagement does not include: financial, investment, government, payment-app, and crypto-exchange accounts. We detect these and provide a checklist; the balances and assets in them transfer to next of kin, who handle them directly. We do not take custody of, move, or distribute any funds or assets.

2. We do not give legal advice

  • We do not provide legal advice. Questions of probate, executor or administrator authority, inheritance, will interpretation, or digital-asset law are for a licensed attorney, not for us.
  • When we help complete a platform's deceased-user or legacy form, we act as a scrivener — we fill in the facts you supply. We do not advise you on which legal status to claim or whether you hold a particular legal right.
  • When we review your proof-of-authority documents, we check them for legibility and for a name and date match only. That review is not a legal opinion that any document is valid or sufficient.
  • Any general reference we provide about what a platform or institution typically requires is general information, not legal advice about your specific estate. Consult an attorney for that.
  • We do not provide financial or tax advice.
  • We do not access accounts by guessing or circumventing passwords. We work only through official platform processes.

3. Your authority, and your representation to us

You represent and warrant that you are authorized to instruct us with respect to the Subject's accounts — as the account holder (pre-planning) or, post-death, as the executor, administrator, surviving spouse, or next of kin with documentation appropriate to that role.

Documentation we rely on, by role:

  • Letters Testamentary / Letters of Administration (or your state's equivalent court appointment) — strongest authority; we may act on the full scope you direct.
  • Small-estate / transfer-by-affidavit instruments where the estate qualifies — mid-tier authority for the scope the instrument reaches.
  • Death certificate plus your signed authority affirmation, where no probate has opened — weakest tier. We proceed on closure or memorialization only, never access to the content of communications, and we rely on the platform's own deceased-user gate as the backstop.

You agree that:

  • We may rely on the documentation and representations you provide without independently verifying their legal sufficiency.
  • We may request further documentation and may decline or pause action until it is provided.
  • You will tell us promptly if your authority changes, is challenged, or ends.
  • You indemnify and hold the Company harmless from any claim, loss, or expense arising out of your representation of authority being inaccurate or out of our acting in reliance on it.

Sworn forms: where a platform's form must be signed under penalty of perjury or contains a sworn attestation of your authority, you sign it personally. We prepare and submit; we do not swear to facts that are personal to you. Where a platform form is a routine request with no oath, you authorize us to submit it as your designated agent under this engagement.

4. Credentials, evidence, and data retention

  • We do not collect, store, request, or hold your or the Subject's account credentials — no passwords, security answers, recovery codes, 2FA secrets, or seed phrases, ever. We act through the official deceased-user or legacy process each platform provides, which relies on a death certificate and proof of authority, not on logging in as the Subject. Where an account can only be acted on by logging in and offers no legacy mechanism, we guide you — as the person with lawful access — rather than take custody of any credential.
  • We do not require you to purchase or sign up for any third-party service to work with us.
  • We collect only the minimum personal data needed to perform the service.
  • Evidence documents (death certificate, proof of authority, and any document containing sensitive personal information such as a Social Security number or cause of death) are deleted ninety (90) days after the case closes, and that deletion is logged.
  • The case record and audit log (metadata about what was requested, submitted, and completed — without the sensitive evidence images) are retained for seven (7) years so we can defend against claims and meet tax obligations.

How your data is handled is described further in our Privacy Notice.

5. Fees

The fee is a flat amount, agreed and paid before work begins, per the package selected:

ServiceFee
Standard Closure — we check every platform we track$300
Custom Closure — Standard, plus accounts you name$400
Standard Closure — planned (purchased while living; activates when needed)$300
Custom Closure — planned (Standard planned + named accounts and legacy-tool setup)$400

The fee covers the service described in Section 1 for the Subject named on your engagement. It does not include financial, investment, government, payment-app, or crypto-exchange accounts, which are out of scope (Section 1).

6. Limitation of liability

  • No outcome or timeline guarantee. Platforms control whether and when they close, memorialize, transfer, or release an account. We control our own diligence only. We do not guarantee any particular platform outcome or timeline, and we are not responsible for a platform's decision, delay, or refusal.
  • Liability cap. To the fullest extent permitted by law, the Company's total liability arising out of or related to this engagement is capped at the amount of the fee you paid.
  • No consequential damages. The Company is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost opportunity, or emotional distress, arising out of this engagement.
  • Client indemnity for authority. As stated in Section 3, you indemnify the Company for losses arising from your representation of authority being inaccurate.
  • Nothing in this section limits liability that cannot be limited under applicable law, including the Company's own fraud or intentional misrepresentation.

7. Refunds, payment disputes, and ending the engagement

Refund policy (in full, below):

After a death.

  • If we cannot perform the service — for example, the required documentation (death certificate, proof of authority) is not provided or does not pass verification within thirty (30) days of payment — the fee is refunded in full.
  • Once platform submissions have begun, the work is not reversible and fees are not refundable. Our work at that point has been performed.

Planning ahead.

  • We do not ask for documents when you buy a plan, so nothing is due from you at purchase.
  • Before your plan is activated, you can ask us to delete it at any time and we will refund your fee in full, to the card you paid with. If that card is closed by then, we will work out another way to get it back to you.
  • When your plan is activated it becomes a case, and the case terms apply from that point. If we cannot perform the service — for example, the required documentation is not provided or does not pass verification within 30 days of activation — the fee is refunded in full. Once platform submissions begin, the work is not reversible and fees are not refundable.

Payment disputes and chargebacks. Once platform submissions have begun, disputing or charging back the payment does not reverse the completed work, and the agreed fee remains due. You agree that completed submissions are non-refundable regardless of a payment dispute initiated afterward.

Ending the engagement. Either party may end the engagement in writing.

Contested authority — suspension or termination. We act only on the instructions of the single Client named on the engagement. If authority is contested — heirs disagree, instructions conflict, or a second person claims authority over the same accounts — we will suspend action and require either resolution among the parties or documentation establishing who controls (for example, Letters naming a personal representative). We may terminate the engagement if the conflict is not resolved in a reasonable time. We do not adjudicate competing family claims.

8. Governing law and acceptance

This engagement is governed by the law of the State of Wisconsin, without regard to its conflict-of-laws rules. Savings clause: if you reside outside Wisconsin, the mandatory, non-waivable consumer-protection rights of your home state are not waived by this clause where they cannot lawfully be waived.

The parties agree this engagement may be presented, accepted, and signed electronically under the Wisconsin Uniform Electronic Transactions Act (Wis. Stat. ch. 137) and the federal ESIGN Act, and that an electronic signature has the same effect as a handwritten one.

This engagement, together with the Privacy Notice and Terms of Service you agreed to at checkout, is the entire agreement between us on this subject.
